$290,000 Nursing Home Settlement

Senior Associate Tia Garcia and Associate Michael A. Fields secured a $290,000 settlement, a significant legal victory in a nursing home negligence case involving a vulnerable 77-year-old woman in Rockland County who contracted COVID-19 in March 2020 while residing in a long-term care facility.
The team successfully opposed the defendant’s motion to dismiss under the Emergency or Disaster Treatment Protection Act, allowing the claim to proceed and reinforcing accountability standards for nursing homes during the pandemic.
